What it does

Law No. 132 of 23 September 2025 ('Disposizioni e deleghe al Governo in materia di intelligenza artificiale') made Italy the first EU member state with a national AI statute layered on the EU AI Act. It designates AgID as the notifying authority (promotion, notification of conformity-assessment bodies) and ACN as the market-surveillance authority (inspection and sanction powers under the AI Act). Implementing decrees on governance, training, biometrics and liability were being adopted through 2026. Banca d'Italia, CONSOB, IVASS and Garante Privacy retain sectoral competence. ACN is a genuine enforcement authority; AgID is largely administrative.

Honest assessment

Italy is an EU member state, so the operative public route for a foreigner is the EU AI Act's own complaint mechanism to the national market-surveillance authority (ACN) — Article 85 gives ANY person the right to lodge a complaint, with no nationality requirement. That right is real and legally binding. The practical barrier is language: ACN and AgID operate in Italian, and I could not verify an English-language complaint form.
