What it does

Investigates maladministration by EU institutions, bodies, offices and agencies — which includes the European Commission and therefore the AI Office, DG CONNECT, and the AI Act's governance bodies. Can open own-initiative inquiries, demand documents from institutions, make findings of maladministration and issue recommendations; can refer a refusal to comply to the European Parliament. It CANNOT overturn a decision, fine anyone, or act against private companies or Member State authorities.

Honest assessment

A real and surprisingly effective route, but only for a specific complaint type: that an EU institution handled something badly — refused access to documents, failed to consult properly, missed a legal deadline, or had an undeclared conflict of interest. Applied to AI, that means the Ombudsman is the address if the AI Office refuses your document request, or if a consultation was run unfairly, or if expert-group appointments were opaque. The Ombudsman has previously found maladministration in Commission expert-group composition and in access-to-documents refusals, which is directly relevant to the Scientific Panel and Advisory Forum selection processes. It is NOT an address for complaining about an AI system, a company, or the content of EU law. Note the two mandatory preconditions: prior contact with the institution, and the two-year limit — complaints fail on these more often than on the merits.

Notes

Pair it with an access-to-documents request under Regulation 1049/2001 first: the refusal is what creates the admissible Ombudsman complaint.
