Predecessor history: SB 24-205 enacted 2024; SB 25B-004 (Aug 2025 special session) pushed its effective date to 30 Jun 2026; AG delayed enforcement Apr 2026; a federal court then restrained enforcement.

VERIFIED, WITH LITIGATION RISK — SB 26-189 drops SB 24-205's algorithmic-discrimination duty of care and risk-management program in favor of disclosure/transparency plus consumer rights over ADMT in consequential decisions. A federal district court ordered the AG not to initiate enforcement of SB 24-205 or replacement legislation for conduct occurring before 14 days after it rules on x.AI's preliminary-injunction motion, so the 1 Jan 2027 date is not secure.
